GENERAL CONDITIONS OF SALE FOR SALE
1. Preliminary provisions
1.1 These General Conditions of Sale govern the sale of the Products (as hereinafter defined) on the website www.https://pitstopcamper.com/it/ (hereinafter the "Site") by PitStop Camper di Leonardo Niccoli with headquarters in Via di Scandicci 310/ A – 50143 - Florence (FI) and VAT number 02332760970 (hereinafter “PitStopCamper”).
1.2 The purchase contract is concluded exclusively through the Buyer's access to the above address and the conclusion of a purchase order according to the procedure provided by the site itself.
1.3 Before making an online purchase through the Site, we invite you to read these General Conditions of Sale in their entirety, accepting them by placing a flag on the indicated box, as well as reading the Information on the processing of personal data.
2. Who can buy – Buyers
2.1 The Products are offered for sale
· to final consumers, meaning natural persons acting for purposes not related to any commercial, entrepreneurial or professional activity carried out (hereinafter the "Buyer" or the "Buyers"). Final consumers are all those who purchase exclusively with a "commercial document" and do not have a "VAT number" registered with the Revenue Agency, but only your tax code. In this case the "consumer code" is applied and the Buyer has the possibility to take advantage of the right of WITHDRAWAL as per paragraph 8 of these GCS. It is also necessary that the Buyer is an adult.
· to professionals such as natural and legal persons acting in the exercise of their entrepreneurial or professional activities, or their intermediary, holders of a VAT number registered with the Revenue Agency (hereinafter the "Buyer" or the "Buyers").
3. Information, presentation and price of the products.
3.1 The products available on the Site are products and accessories for campers, caravans, gas cylinders, etc. All information on the essential characteristics of the Products is provided next to the image of each Product. In any case, in good time, before the conclusion of the purchase contract, the Buyer will receive the information required by the art. in a clear and comprehensible manner. 52 of Legislative Decree 6 September 2005 n. 206; furthermore, before submitting the Purchase Order (as defined below), the Buyer will receive the information required by the art. 12 of Legislative Decree 9 April 2003 n. 70.
3.2 The images of the Products offered for sale on the Site may not be displayed correctly by the Buyer and may therefore not correspond exactly to those uploaded on the Site, due to the effects created by the Internet browser used or the monitor used by the Buyer ( colors, proportions, etc). The prices and technical and aesthetic characteristics of the products are valid only on the date on which the order is concluded; they can be changed at any time and cannot be used as a reference for subsequent purchases. If in doubt, ask for clarifications and/or clarifications before making the purchase.
3.3 The prices of the Products are in Euros. Prices do not include shipping costs, which will be charged to the Buyer for each Purchase Order (as defined below).
3.4 PitStop Camper reserves the right to cancel orders in the event that some prices displayed are incorrect due to IT, or manual, or technical error, or of any other nature, which may result in a substantial change and not included in the public sale price. In this case the amount paid by the Buyer will be refunded within 7 days from the day of cancellation.
Purchases made with a delivery request for DISCONVENIENT AREAS are excluded from the flat-rate transport cost and the localities Livigno, Trepalle and Campione d'Italia. For these locations and for all international shipments, including San Marino and Vatican City, the customer must request the relevant cost in advance.
It is specified that the cost of transport requested and charged to the Buyer during the purchase process is in any case to be considered as a CONTRIBUTION, compared to the actual cost of shipping.
4. How to buy
4.1 To conclude the purchase contract for one or more Products on the Site, the Buyer must access the Site and after having selected the Product or Products he intends to purchase, he must complete and send to PitStop Camper electronically a purchase order for the Selected Products, indicating the Product(s) you are requesting to purchase, the payment method chosen from those available and the personal data necessary to process the order (hereinafter the "Purchase Order"). For further information regarding the preparation of a Purchase Order, we invite you to access the contact section.
4.2 The Purchase Order consists of a web page in which the Buyer must indicate some of his personal data (name, surname and address of the tax documentation as well as the shipping address if different, payment data). Please note that the data in the tax documentation must coincide with that of the credit card used for payment.
Before sending the request to purchase the Products, by transmitting and confirming the Purchase Order electronically, the Buyer will be asked to carefully read the information contained therein, in order to:
· correct any errors or omissions,
· print or store a copy of the Purchase Order,
· add, modify or delete items in your shopping cart.
After this verification, the Buyer will be able to confirm the Purchase Order by clicking on the "Confirm Order" button: until this button is entered and the Purchase Order is therefore confirmed, the Buyer will be free not to complete the order of Purchase or to modify it, for example by deleting some Products from the cart. In order to conclude the purchase of the Products it will also be necessary
· read and accept these General Conditions of Sale
· read the information relating to the processing of personal data.
4.3 The Purchase Order will be transmitted to the PitStop Camper database for the period of time necessary to process the Purchase Order, verify payment, deliver the Product, as well as generally process it , pursuant to the law.
4.4 The Product purchase contract is concluded when PitStop Camper receives and accepts, electronically and with an automatic response process, the Purchase Order. After having verified the correctness of the data entered, PitStop Camper may not process the Purchase Orders:
· that are incomplete, incorrect or incorrect,
· in the event of even temporary unavailability of the Products
· if some prices displayed are incorrect due to error as per point 3.4.
In these cases, PitStop Camper will promptly inform the Purchaser (and in any case within seven days starting from the day following the day on which PitStop Camper receives the Purchase Order), by e-mail to the address indicated by the Buyer in the Purchase Order (unless the address in question is incorrect), that the contract is not concluded, specifying the reasons. In the event that the Buyer has already paid the price of the Product and the shipping costs, the corresponding amount will be refunded (in the manner specified in Article 5 below).
5. Payment
5.1 When sending the Purchase Order, the Buyer will be asked to choose one of the following payment methods for the Products:
a) Visa, Visa Electron and Mastercard credit and prepaid cards. For payments made by credit card (Visa, Visa Electron and Mastercard circuits), the Buyer's financial information (for example, the card number or its expiry date) will be sent, via encrypted protocol, to the credit institution. Banca Sella credit with GestPay without third parties having access to it. Furthermore, this information will be used by PitStop Camper solely and exclusively to complete the procedures relating to the purchase by the Buyer and to issue the relevant refunds in the event of any return of the Products, following exercise of the right of withdrawal by the Buyer. of the Buyer, or if it is necessary to prevent or report to the police the commission of fraud or crimes relating to the Site.
b) PayPal. Method that allows payment even without opening a PayPal account and with any credit card, including prepaid ones.
c) Bank transfer to be made to our current account. You will be informed of our. bank details during the order process. The goods will be shipped only after verification that the amount has been credited, which normally takes 2 to 4 days due to bank deadlines.
6. Delivery
6.1 The Products will be shipped to the address indicated in the Purchase Order only after the payment of the Purchase Order itself has been duly registered and provided that the order amount has been credited. Except as indicated in Article 4.4 above, the Products will normally be shipped within 5 (five) days and in any case no later than 15 (fifteen) days starting from the day following receipt of the Purchase Order by PitStop Camper . Once delivery to the carrier by PitStop Camper has taken place, a confirmation email will be sent to the Buyer indicating that the courier has been assigned and, normally the following day, the tracking number will automatically be sent to care of the transporter. The shipping costs to be paid by the Buyer, where due, will be those indicated in the appropriate field within the Purchase Order to the extent indicated in Article 3.3.
6.2 The Products will be shipped by PitStop Camper to the Buyer via couriers belonging to carriers who are completely autonomous and independent of PitStop Camper (such as GLS, SDA, UPS, BRT, DHL, FEDEX, or others). The delivery terms indicated next to the carrier's logo when choosing the courier are the indicative average travel times and vary depending on the destination location. Except in cases of willful misconduct or gross negligence, PitStop Camper will in no way be responsible for any delivery delays due to the responsibility of the carriers, or to causes not attributable to it.
Upon receiving the goods at his home, the Customer must check the integrity of the packages; it will be the courier's responsibility to have the lack of integrity of the package pointed out and accurately noted by the courier, under penalty of forfeiting the ability to assert one's rights in this regard. DO NOT APPLY GENERIC RESERVATION OF VERIFICATION CLAUSES ON THE COURIER DOCUMENT WHICH HAVE NO VALUE BUT SPECIFY THE TYPE OF ANOMALY FOUND. This written indication, placed on the courier's document, is the only way to take action against him. In any case, the shipment constitutes delivery of the goods which from that moment are no longer available to the Seller.
In the event of failure to deliver by the carrier due to the absence of the recipient, or other causes dependent on the recipient himself, after a second delivery attempt the courier will keep the package in storage leaving a notice for collection or redelivery request. If the package returns to our warehouse, we will set it and it will remain available to the customer until requested. Upon the customer's instructions, we will re-forward the product to the destination address after payment of the return and reshipping costs.
7. Product warranty
7.1 The Products available on the Site are guaranteed, in accordance with the law, for defects in conformity that appear within 2 (two) years of delivery to the consumer customer. To prove the date of purchase it is necessary to present the purchase receipt or the electronic payment receipt. The guarantee is reduced to 1 (one) year in the case of issuing a tax invoice to subjects with a VAT number.
7.2 To exercise the right relating to the guarantee of the Products purchased, the Buyer must complete the information request form specifying the nature of the request and will be contacted as soon as possible by PitStop Camper who will send the form to exercise the guarantee right.
7.3 The warranty does not apply if the Product has been damaged, even accidentally, due to the negligence of people other than PitStop Camper and by tampering not authorized by PitStop Camper by the Buyer or third parties. It should be noted that complex products and spare parts that require assembly and/or installation in a system or plant by qualified workshops or installers can be sent to the manufacturer's assistance laboratories only if the workshop that carried out the assembly in order to be able to contact you and have detailed information to transmit.
7.4 It is understood that the Buyer will not be charged any expense for exercising the right to the legal guarantee in relation to the Products purchased. In the event that the Manufacturer (or the Assistance Center authorized by the same), during the analysis of the product declared defective, finds that it has instead been damaged by external cases due to incorrect use or installation, the customer will be asked for the costs shipping and reshipping, in addition to what will be requested by the manufacturer to identify the causes of the defect.
8. Right of withdrawal
Purchases made on the WWW.PITSTOPCAMPER.COM website are governed by the Italian law on mail order sales. Pursuant to the articles. 64 et seq. Legislative Decree 206/2005, theConsumer customer, i.e. a natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out, has the right to withdraw from the purchase contract for any reason, without having to explain the reasons and without any penalty.
To obtain the application of the right of withdrawal and reimbursement of the expenses incurred, the conditions indicated below must be respected.
a) The intention to exercise the right of withdrawal must be communicated to the Seller within a maximum of 14 (fourteen) working days from the date of receipt of the goods;
b) the right of withdrawal must be expressed and exercised by sending a registered letter with acknowledgment of receipt to:

together with a copy of the receipt or receipt of the electronic purchase payment. The above address is also the return address of the goods.
The Buyer is asked to wait for the RMA (RETURN AUTHORIZATION) from the Seller via email before shipping. The Seller will issue the RMA once the times for exercising the withdrawal conditions referred to in point a) above have been verified.
· the right of withdrawal applies to the product in its entirety and not to parts or components of it;
· the right of withdrawal does not apply to products purchased by the Customer on our website which contain the express wording MADE TO ORDER in the description and/or with a delivery time of 15/20 days, as they are not "shelf" products but have been supplied expressly upon request of the Customer to our suppliers and cannot be returned to them. Examples include custom-made mattresses, cutting to size of profiles, gaskets and the like, and any other product bearing the above-mentioned wording.
· in the case of prize operations or combined promotional sales, in which the purchase of a good is associated with another good that is sold at a negligible price (or given away), the right of withdrawal will be legitimately exercised with the return of both goods object of the purchase (given the constraint of the accessory nature of the promoted good compared to the first);
· the Buyer will be required to pay only the direct costs of returning the products. The return of the product will be the responsibility of the Buyer who will be responsible in the event of loss or damage to the product. In the event that PitStop Camper is asked to send the courier to the Buyer's address for collection, the transport cost will be a minimum of €15.00 for non-bulky packages. For bulky packages, the relevant cost must be agreed from time to time between PitStop Camper and the Buyer.
· the Seller will refund the entire amount paid by the Customer and for which he has exercised the right of withdrawal, provided that the good arrives in its original packaging, complete with all the integral elements of the good (tags, labels, information notes, etc.), is intact and not damaged during transport, not even used in the slightest. If the product is in a sealed package, it must be returned as is, as only in this way will it be salable again. In particular for electronic products, the packaging must be intact and the product must not have been connected to the system.
· in the event of discrepancies with the above, the Seller will evaluate any costs for repairing the damage, communicating the refundable amount to the Customer;
· in the event that the Buyer has sent the goods to the Seller but the right of withdrawal is then lapsed, the Seller will make the goods purchased and already in his possession available to the Buyer, making it available for collection by and at borne by the Buyer in the manner that the latter wishes to communicate.
9. Refund of sums paid
9.1 Regardless of the payment method used by the Buyer, the refund procedure is activated by PitStop Camper in the shortest time possible and in any case within 15 (fifteen) days from the date on which PitStop Camper became aware of the exercise of the right of withdrawal , after verifying the correct execution of the procedure and acceptance of the returned Products.
9.2 If there is no correspondence between the Buyer of the Products indicated in the Purchase Order and the person who made the payment of the sums due for their purchase, in the event of exercising the right of withdrawal, PitStop Camper will refund the sums paid exclusively to the person who made the payment: in this case, PitStop Camper will still be released.
10. Complaints
Any complaints may in any case be sent to PitStop Camper at the following address: PitStop Camper di Leonardo Niccoli, Via di Scandicci 310/A 50143 Florence, to the attention of E-commerce or via e-mail to info@pitstopcamper.com inserting "complaint" in the subject of the communication.
11. Force majeure
Except in cases of willful misconduct or gross negligence, PitStop Camper will not be liable, will be released from any contractual obligation to make or deliver and will not be required to pay any compensation or indemnity in the event of failure to fulfill its obligations due to causes not attributable to PitStop Camper or to events of force majeure, such as, but not limited to, riots, insurrections, social unrest, telephone or IT failures or serious damage to the security and operation of the internet, strikes and impossibility of supply (even temporary) of Products and materials.

13. Dispute Resolution
13.1 Italian law applies to these general contract conditions, including the provisions of Legislative Decree no. 6 September 2005. 206, and, in particular, the legislation dictated regarding distance contracts (articles 50 to 68), as well as the provisions of Legislative Decree no. 9 April 2003. 70 on e-commerce.
13.2 The Buyer is in any case free to appeal to the competent judge at his residence or domicile.
